1. Information We Collect
1.1. Account Information
Name, email address, password, and other details provided when creating an account.
1.2. Payment Information
Billing address and payment method (collected and processed by our third-party payment provider such as Stripe). We do not store full credit card details.
1.3. API Keys and External Credentials
Any third-party API keys you voluntarily input are securely stored and used solely to operate the features you request. Scrptly is not responsible for unauthorized access caused by leaked or stolen credentials.
1.4. Usage Data
IP address, browser type, device information, access times, pages viewed, and actions taken on the platform (e.g., uploads, exports, API calls).
1.5. Media and Project Data
Uploaded or generated media assets (e.g., text, images, videos, audio) and project metadata required to provide our Services.
2. AI Agent Data and Prompts
When you use Scrptly’s AI agent to generate content you provide: input prompts, optional context images, and configuration parameters. To deliver the Service we may transmit these inputs, together with additional internal prompts or processing cues, to our internal systems and to third‑party sub‑agents that perform specific tasks (for example image generation, text‑to‑speech, or video synthesis).
- What we transmit: the original prompt text, context images you supply, derived prompts, metadata (e.g., timestamps, project id), and limited usage telemetry needed for billing, debugging, and abuse prevention.
- Purpose: to generate media, produce previews, enable billing and quotas, detect abuse, and improve our Service.
- Storage: prompts, context images, model outputs, and associated metadata may be logged and stored as described in the "Data Retention" section.
3. Tokens, Billing & Quality
Scrptly’s AI agent is priced on a token basis. Actions such as generating a screenplay, creating a scene video, producing narration, or other agent operations consume tokens. Token pricing, allowances and extra token prices are disclosed in-app.
- Token usage: tokens are deducted as actions execute. Tokens are non‑exchangeable and non‑refundable except as required by applicable law.
- Subscription allowances: subscription plans may include a monthly token allowance; unused tokens expire or reset at the start of each subscription period per plan terms.
- Quality & retries: AI outputs may vary. Multiple attempts may be necessary; token consumption applies to each attempt. Poor or unsatisfactory results are not refundable or exchangeable.
- Estimates: in-app estimates of token cost are approximate; final token consumption is determined by executed actions.
4. Use of Internal Integrations and Third‑party Sub‑agents
For the AI agent we use our own internal provider credentials and a combination of internal integrations and third‑party model providers (sub‑agents).
- Internal integrations: where we operate the integration with our provider credentials, billing and token accounting are managed by Scrptly.
- User-supplied keys: some optional integrations require you to supply API keys; you are responsible for securing those keys and for charges incurred when you use them.
- Third‑party sub‑agents: when a sub‑agent is used, we may share prompts, context images, and derived cues with that provider. Each sub‑agent is governed by its own terms and privacy policies.
- We do not act as a billing intermediary for third parties and cannot resolve disputes between you and external API providers.
5. Generated Content Retention
We may retain generated outputs (images, videos, audio, transcripts), prompts, and context images for a limited period to provide previews, allow downloads, process renders, maintain billing records, and for abuse prevention and service improvement.
- Short-term retention: generated assets required for rendering, previews, and immediate downloads are retained as long as necessary (for example, typical temporary storage windows used for render processing).
- Long-term retention & backups: project and media data associated with your account may be retained according to your plan and our retention policies. We may delete or archive content after prolonged inactivity in accordance with account settings and plan terms.
- Aggregated/anonymized data: we may keep anonymized or aggregated usage data indefinitely for analytics and product improvement.
6. Security and Handling of Prompts & Context Images
We implement reasonable administrative, technical, and physical safeguards to protect prompts, context images, and generated outputs. Access to prompts and media is restricted to authorized personnel and systems that require access to provide the Service.
- Encryption: sensitive data is encrypted in transit and at rest where applicable.
- Access controls: internal access is logged and audited to the extent practicable.
7. Automated Decision Making & Model Improvements
We may use automated systems (including machine learning models) to process prompts and generated outputs for rendering, moderation, billing calculations, and product improvement. Aggregated and de‑identified prompts/outputs may be used to improve models and service quality. If you prefer not to contribute de‑identified data for model improvement where applicable, please contact support to learn about available options.
8. Legal Use, Responsibility & Liability
You are solely responsible for the content you create, upload, generate, or distribute using Scrptly. Scrptly does not endorse or guarantee the legality, accuracy, or appropriateness of user‑generated content.
- Compliance: you must ensure your use complies with applicable laws, third‑party rights (copyright, trademark, privacy), and these Terms.
- Indemnity: you remain responsible for any claims or liabilities arising from your content or use of generated outputs.
- Moderation: we may moderate, remove, or refuse to publish content that violates our policies or applicable law.
9. Cookies and Tracking
We use cookies and similar technologies to:
- Maintain session state.
- Analyze usage patterns.
- Store user preferences.
You can disable cookies in your browser settings, but some features of the Service may not function properly.
10. Sharing of Information
We do not sell your personal information. We only share your data with:
- Service providers (e.g., cloud hosting, payment processors) as needed to operate Scrptly.
- Third‑party sub‑agents and model providers.
- Legal authorities if required by law or legal process.
11. Data Retention Summary
- Account data: retained while account is active, unless deleted by you.
- Project & generated media: retained according to your plan, project settings, and our retention policies; temporary assets used for rendering may be deleted after processing.
- Logs & backups: may be retained for operational, security, or legal reasons.
12. International Users
Scrptly is based in Canada. If you access the Service from other jurisdictions, you consent to the transfer and processing of your data in Canada and other applicable locations.
13. Children’s Privacy
Scrptly is not intended for children under the age of 13. We do not knowingly collect personal data from children.
14. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be posted with a new "Effective Date" and, where appropriate, notified via email or the platform.
